Terms of Service

By checking the “I agree to the Terms & Conditions” option box and completing your purchase via the websitefolk.com website, you indicate your acceptance of the terms and conditions set forth in this document.

Description of Goods and Services

You are purchasing a semi-custom website. Your website will have the same layout and features as those displayed in the Examples section of our website. Your website will feature the custom content listed at www.websitefolk.com/content/.

Your website will feature a modern responsive design that displays well on all devices; from smartphones to desktops to TVs. Your website will be optimized to load quickly, even on slow internet connections.

When you purchase one of our websites you are required to subscribe to our fully managed website maintenance solution for $10/month. This includes:

  •     Website hosting on fast, secure servers
  •     Timely security and performance upgrades to your website
  •     Security hardening and monitoring to keep your site from being hacked
  •     Backups and restoration in the case of disaster or a hacked site
  •     One website content update per month

Websites purchased via websitefolk.com cannot be moved to another host. If you notice any problems with your site or if you need to update your content you can submit a support ticket to support@websitefolk.com and we will take care of the issue.

Delivery of Goods and Services

A PDF workbook will be emailed to you as soon as you complete your transaction. This short workbook guides you through the process of providing the custom content for your website to us. According to customer feedback, it takes an average of two hours to complete the workbook.

Once we receive your completed workbook assignments, we will build your site on our development server. This process generally takes about 48 hours. You will receive an email alerting you that we have begun, and when we are finished you will receive another email containing a preview link for your new website.

Once you receive the preview link you should carefully proofread your site and submit any corrections that may need to be made according to the instructions provided. You will be given three header graphics to choose from, and you will need to inform us of your selection.

Once you have proofed and approved your new site we will publish it live on your domain. This generally occurs within 24 hours of your approval. Once your site is live on your domain we will setup the email accounts you have requested and email you the account information for them.

We will maintain your site on our fast and secure servers, periodically update the code of your website to ensure performance and security, scan your site for signs of malware or hacking, keep daily backups of your website and restore your website in the case of disaster or a security breach.

We will update your website content once per month. If you need more frequent updates you will be charged at a rate of $25/per update. If you notice a technical issue with your website or would like to request a content update email support@websitefolk.com

Your Responsibilities

If you are not comfortable sending emails with attachments you may need to enlist a friend or family member to help you complete the workbook assignments. We will not start any work on your website until we receive all of your completed workbook assignments.

We do not own your domain. You must purchase your own domain and point it to our servers. It is your responsibility to pay for your domain and keep it from expiring. Instructions for purchasing and pointing the domain are included in the PDF workbook that we will send you.

It is your responsibility to keep your credit card details up to date to ensure timely payments and uninterrupted service.

Termination & Refunds

Refunds will not be issued if you fail to submit your site content. However, if you decide that you are not going to complete your website you may email support@websitefolk.com and request for your monthly website maintenance subscription to be terminated.

If you discontinue your website maintenance subscription your site will be deleted 30 days after your first missed payment, but we will maintain a backup of your site that can be restored for an additional six months. You will receive a missed payment alert via email and we will attempt to contact you by phone before deleting a site for missed payment.

We reserve the right to edit submitted content for grammar, flow and proper Internet copy styling. We reserve the right to reject any submitted photos that do not fit the style and layout of the site. We reserve the right to refuse to publish objectionable content. If, for whatever reason, we refuse to publish the content that you have submitted and an acceptable compromise cannot be reached, we will refund your payment in full.

Data Privacy

We maintain an active SSL certificate on the websitefolk.com website and use third party billing providers to store and process your credit card information and transaction history. The providers we use for billing are PayWhirl and Stripe, both of whom are fully PCI compliant. We do not store any financial data on our servers.

We also use a third party service provider for our customer relationship management, support desk and email marketing software. Your customer details and communication history are stored on their servers.

We do not sell or share your data with any other entities than those listed in this document. We only share data with the specified entities according to the use case scenarios defined in this document.

We may occasionally send you emails when we launch new products or services that may interest you. You may opt out of these emails at any time.

Limitation Of Liability

We are not liable for any damages that you may incur as a result of the existence, accuracy or performance of your website.

Notification of Changes

This is a living document that is subject to periodic changes. All registered users will be notified of updates to the Terms of Service via their registered email address. This document was last updated December 1st, 2016.
